Kanye West didn’t want you to see him popping the question to Kim Kardashian. At least, not until the video airs on the E! network. West and Kardashian have sued YouTube co-founder Chad Hurley for uploading proposal footage to his new MixBit online-video service — footage that was, no joke, being filmed for cable TV.

In a complaint obtained by The Hollywood Reporter, West and Kardashian claim Hurley crashed their engagement as the companion of an invited guest. They let him stay on the condition that he signed a confidentiality agreement blocking him from posting information about the festivities. The lawsuit also beautifully disses the YouTube co-founder’s current project, calling it a “new but foundering business” and accusing Hurley of seeing the party as a chance to promote MixBit.

Officially sanctioned footage of the proposal could still someday see the light of basic cable. According to the lawsuit, West entered a contract with a company called M Cable Television, which has often worked with West and Kardashian, “to film and broadcast the marriage proposal.” M Cable Television transferred its lawsuit rights to E! Entertainment Television, which passed those rights along to West and Kardashian.

West and Kardashian are seeking a full array of damages from Hurley, who sold YouTube to Google for $1.65 billion. As for the Yeezus rapper, he might have some time on his hands, considering he has been forced to cancel a handful of tour dates. He also recently appeared in a video for Jared Leto’s 30 Seconds to Mars — see, there’s where he could’ve used a confidentiality agreement.
